Will of Robert Flack
In the name of God Amen.
I Robert Flack of New Britain Township in the County of Bucks in the State
of Pennsylvania being weak in body but of sound and disposing mind and memory
blessed by God for the same Considering the uncertainty of this mortal life
do make and publish this my last Will and Testament in manner following.
In the first place I command my soul unto the hands of my Creator who gave
it, and my Body to the earth to be interred in a decent and Christian like manner
and as for and concerning such worldly estate wherewith it hath pleased God
to bless me in this world I will and order that my just Debts and funeral expenses
be first paid, and then I give and dispose of as follows Viz.
I give and bequeath unto my beloved wife Mary the sum of Two hundred and fifty
Dollars.
I further give and bequeath unto her, her Bed and Bedding and all and every
such things and furniture as she shall please to put into her Room to furnish
the same.
Item, I give and bequeath unto her one cow she taking her choice.
I also give and bequeath unto her all that my Messuage ( definition = A home
with its adjoining buildings and adjacent land.) and plantation Whereon I now
live together with the appurtenances to have and to hold unto her during the
term of her Natural life to take and receive the profits thereof and to have
full possession thereof during the said term of her natural life.
Further I give and bequeath unto my eldest son James Flack the sum of Two hundred
and fifty Dollars.
I also give and bequeath unto my son Henry Flack the sum of Two hundred Dollars.
Item I give and bequeath my three other sons namely Thomas W Flack, Robert
Flack and William Flack the sum of one hundred Dollars a piece.
I also give and bequeath unto my Daughter Mary the sum of fifty Dollars. I
also give her the sum of fifty Dollars more for taking care of and bringing
up my little grand Daughter Alemina McEwen.
I give and Devise unto my said two sons James Flack and Henry Flack and to
their Heirs and assigns from and immediately after the decease of my beloved
Wife Mary all that my Messuage and Plantation Wheron I now live Containing about
eighty five Acres and a quarter together with all and singular the appurtenance
thereunto belonging as in any wise appertaining to have and to hold the same
from and after the Decease of my said Wife Mary to the said James Flack and
Henry and their heirs and Assigning for ever as Tenants in Common and in equal
parts and I also Will and order that my said two sons James Flack and Henry
Flack in Consideration thereof or their hiers as Assignors shall pay for the
same the sum of fife thousand and one hundred Dollars to be paid as follows
Viz.
The sum of eight hundred Dollars to be paid within one year after my wifes
decease and the remainder of the fife thousand and one hundred Dollars to be
paid in annual payments of two hundred Dollars a year with lawful Interest for
the same from the expiration of one year after the decease of my said beloved
Wife which Interest is to be annually and regularly paid and the monies arising
from the said real Estate as aforesaid together with all other such of my personal
Estate of what kind and Nature soever and which is not herein before willed
and bequeathed.
I do give and bequeath unto my said five sons and three daughters namely James
Flack, Thomas W Flack, Henry Flack, Robert Flack and William Flack and my Daughter
Ann the wife of Doctor Banes, Sarah the wife of Jacob Picker and Mary Flack
and the legal Heirs of my deceased Daughter Jane late the wife of Andrew McEwan
also deceased that is to say it shall be equally divided amongst the said Legatees
excepting that all the legal Heirs and Representatives of my Deceased Daughter
Jane shall in alltogether be entitled to one share only which share shall be
fifty Dollars less than any of the last mentioned shares in all other points
this last bequests shall be equally divided amongst the said Legatees share
and share alike excepting as before excepted and also that my Daughter Sarah
the wife of Jacob Picker aforesaid shall be entitled only to the Interests of
her said share which Interests shall be annually and regularly paid unto her
and the Principle thereof shall be and remain charged on the above said Real
Estate during her natural life and after her decease the said Principal or share
shall be paid out of said real Estate to the legal Heirs or Representatives
of my said Daughter Sarah any thing before contained to the contrary thereof
notwithstanding.
And I do constitute and appoint my Sons James Flack, Henry Flack and Robert
Flack whole and sole Executors of this my last Will and Testament hereby revoking
annuling disallowing all former wills by me made rectifying and Confirming this
only to be my last will and Testament.
In witness whereof I have hereunto set my hand and seal the fourth day of May
in the Year of our Lord one thousand eight hundred and fourteen. [signed] Robt

ROBERT'S REAL ESTATE - Conditions of Sale & Sale Itself.
The conditions of this present public Vendue (def = the
public sale of something to the highest bidder) held this thirty first
day of October Anno Domini One thousand eight hundred and thirty nine (31
Oct 1839) for the sale of certain messuage and Tract of eighty five acres
and forty four perches of land be the same more or less late the property of
Robert Flack deceased situated in the township of New Britain in the county
of Bucks, with the appurtenances, are as follows to wit the highest and best
bidder is to be the purchaser.
The purchaser to pay down immediately the sum of three hundred dollars of the
purchase money or give his bond if and when required with satisfactory security
for the payment of the same on or before the first day of April next ensuing
this date.
Of the purchase money the principal sum of three hundred and three dollars
and seventy seven cents ($303.77) must remain as
a lien in the said real estate for and during the lifetime of Sarah Pickler
(Roberts daughter) and be paid at her decease unto
her legal heirs or representatives, and the legal interest thereof in the mean
time to be regularly and annually paid to her or her Assigns, on the first of
April in each and every year: and the remaining part of the purchase money is
to be divided into three equal payments, the first day of April next, the second
payment thereof on the first day of April Anno Domini one thousand eight hundred
and forty one (1 April 1841) together with one
year interest thereon; and the third and last payment thereof is to be paid
at the decease or marriage of Mary Flack the widow and relict of the said Robert
Flack deceased, and the interest therof is to be regularly paid unto the said
Mary on the first day of April in each and every year for and during the Term
of her natural life or widowhood.
On the receipt of the first payment above mentioned and the purchaser securing
the two remaining payments by Bond and Mortgage on the Premises, the subscribers
shall and will, at the proper costs and charges of the purchaser make and execute
unto the purchaser a good and lawful Deed in fee simple, subject to the payment
of the aforesaid Lien of three hundred and three dollars and 77 cents ($303.77),
with its intent but clear of all other encumbrances whatsoever. Possession to
be given with the Title.
The Subscribers reserve out of this Sale all the winter grain in the ground
and the usual privileges of harvesting Carracking and thrashing the same, the
straw thereof to remain on the premises and also a sufficiency of firewood reserved
until the first day of April Next.

I Jacob Cassel do hereby acknowledge that I have purchased the above mentioned
premises agreeably to the above mentioned conditions and that the same was knocked
off to me at the sum of Thirty dollars per acre. Witness my hand this thirty
first day of October A.D. One thousand eight hundred and thirty nine
(31 Oct 1839), to be conveyed to Wm Flack.
